一、Introduction
因應社會性騷擾案件頻傳與「Me Too」運動,Executive Yuan於112年7月13日通過三項法案修正:《Sexual Harassment Prevention Act》、《Gender Equality in Employment Act》(更名為《Gender Equality in Employment Act》)及《Gender Equity Education Act》。修法目標為強化「有效」打擊加害人、完備「友善」被害人權益、建立「可信賴」的防治制度。
二、Key Amendments
Strengthening 'Effective' Punishment and Disposition Against Perpetrators
- Newly defining power-based sexual harassment types, clearly distinguishing general and special power-based sexual harassment
- Clearly defining jurisdiction of the three acts: campuses under Gender Equity Education Act, workplaces under Employment Act, others under Sexual Harassment Prevention Act
- Expanding scope to include military/police academies and correctional schools
- Tiered penalties: civil punitive damages up to 5x, administrative fines NT$10,000–1,000,000, general harassment up to NT$100,000, power-based harassment up to NT$600,000; criminal penalties increased by 1/2
- Strengthening external complaint supervision mechanisms
Improving 'Friendly' Rights Protection and Services for Victims
- Protection and assistance codified into law, budget allocated for victim support measures
- Improved confidentiality provisions, prohibiting disclosure of victim-identifying information
- Extended complaint statute of limitations:一般性騷2年(自事件發生起5年);權勢性騷3年(自事件發生起7年);未成年性騷於成年後3年內申訴;雇主性騷於離職後1年內申訴
Establishing a 'Trustworthy' Professional Sexual Harassment Prevention System
- Newly established interim measures for suspension or reassignment of senior officials in serious cases
- Establishing a gender equality committee talent database, training investigators with gender equality awareness
- Introducing civil society resources to assist investigations
